Contractors Insurance in California: What Coverage You Actually Need

California has some of the most complex contractor insurance requirements in the country. Between CSLB licensing requirements, project-specific contract demands, and the need to protect yourself from the very real risks of construction work, understanding what coverage you actually need is essential before you sign another contract.

This guide breaks down the key policies, who needs them, and how to build a complete contractors insurance program without overpaying.

The CSLB Licensing Requirements

The Contractors State License Board requires all licensed contractors in California to maintain specific insurance coverage as a condition of holding an active license. Failing to maintain required coverage can result in license suspension. The core requirements are:

  • General liability insurance — Required for most license classifications. Minimum limits vary by license type but $1 million per occurrence is the standard.
  • Workers’ compensation insurance — Required for any contractor with employees. Sole proprietors with no employees may file a Workers’ Comp Exemption.
  • Contractor license bond — A $25,000 surety bond is required for all active CSLB licenses.

General Liability Insurance for California Contractors

General liability covers third-party bodily injury and property damage arising from your operations. If a client trips over your materials and breaks their arm, or your crew accidentally breaks an expensive window, your GL policy pays the claim and any resulting lawsuit.

Most contractor GL policies are written on an occurrence form, meaning coverage applies to incidents that happen during the policy period regardless of when a claim is filed. This matters for contractors because construction defect claims often surface years after the work is done — “completed operations” coverage within your GL policy handles these.

For most small and mid-size contractors, a $1M/$2M GL policy (one million per occurrence, two million aggregate) is the baseline. Commercial projects, public works contracts, and general contractor agreements frequently require higher limits or specific endorsements including:

  • Additional insured designation for the owner or GC
  • Primary and non-contributory wording
  • Waiver of subrogation
  • Per-project aggregate limits

Workers’ Compensation: When You Need It and When You Don’t

California law is unambiguous: if you have even one employee, you need workers’ comp. But “employee” in California is defined broadly — if you have any workers who aren’t legitimately operating as independent businesses themselves, the state may consider them your employees regardless of how you’ve classified them.

For sole proprietors with truly no employees, the CSLB Workers’ Comp Exemption allows you to avoid purchasing a policy while still satisfying the CSLB’s insurance requirements. Commercial auto coverage protects your work vehicles, covers employees who drive for the business, and can include hired and non-owned auto coverage for rental vehicles or employee-owned vehicles used for company business. If you have multiple vehicles, a fleet policy typically offers better rates than individual vehicle policies.

Contractor’s Tools and Equipment Coverage

Inland marine insurance — commonly called contractor’s equipment or tools and equipment coverage — pays when your tools are stolen from a job site, damaged in an accident, or destroyed. This is separate from your GL policy, which only covers damage you cause to others, not damage to your own property.

You can purchase either a blanket policy (covering all tools up to a set limit) or a scheduled policy (listing specific high-value equipment with individual values). For contractors with expensive specialized equipment like lifts, generators, or diagnostic tools, scheduled coverage ensures you’re properly compensated at full replacement value.

Surplus Lines for Hard-to-Place Contractor Risks

Some contractor risks can’t be placed in the standard admitted market. Roofing contractors, demolition companies, excavation contractors, and contractors with prior claims often receive declinations from standard carriers. Surplus lines (also called E&S) insurance fills this gap.
